IN WHICH YEAR WAS WOTESAWA ESTABLISHED?

WoteSawa was established in 2012.

WHAT IS DOMESTIC WORK?

Domestic Work means work performed in or for a household or households.

WHO IS A DOMESTIC WORKER?

Domestic Worker means any person engaged in Domestic work within an employment relationship

CAN A CHILD BE EMPLOYED IN TANZANIA?

Yes. A child can be employed to light work but it is strictly prohibited to employ a child in any activity that may be harmful to his health, education, mental, physical or moral development. The minimum age for employment or engagement of a child is fourteen (14) years.

WHO IS A CHILD DOMESTIC WORKER?

Is a person of 14 years and above but below 18 years engaged or employed in domestic work within an employment relationship.

WHAT IS THE MINIMUM WAGE FOR A DOMESTIC WORKER IN TANZANIA?

CAN A CHILD DOMESTIC WORKER ENTER INTO A WRITTEN EMPLOYMENT CONTRACT?

Yes, a Child Domestic Worker can enter into a written employment contract for necessities such as food, clothes and shelter.

IS THERE A SPECIFIC LAW IN TANZANIA PROTECTING DOMESTIC WORKERS?

No. However, a Domestic Worker is protected under different labour related laws and regulations in Tanzania; such as: The Constitution of the United Republic of Tanzania, the Employment and Labour Relations Act, the Law of the Child Act, the Anti trafficking in Persons Act, the Law of Contract Act and the Labour Institutions Wage Order.

At the International level, Domestic Workers are mainly protected by the Domestic Workers Convention, 2011 (No. 189) and Minimum Age Convention, 1973 (No. 138).

HAS TANZANIA RATIFIED THE DOMESTIC WORKERS CONVENTION (C189)?

No. Tanzania is yet to ratify the Convention; however, we signed the Convention in 2011 during its adoption in Geneva.

WHAT IS CHILD LABOUR?

The term “child labour” is defined as the engagement of a child in the types of work that deprives children of their childhood, potential and dignity, and that is harmful to physical, spiritual and mental development. It refers to work that is mentally, physically, socially or morally dangerous and harmful to children; or interferes with their schooling by depriving them of the opportunity to attend school; obliging them to leave school prematurely; or requiring to attempt to combine school attendance with excessively long and heavy work. Is an employment that is inappropriate to the age of the child.

WHAT IS EXPLOITATIVE LABOUR TO A CHILD?

Exploitative Labour includes work that:

  • deprives the child of his health or development.
  • exceeds six hours a day
  • is inappropriate to his age.
  • the child receives inadequate remuneration.

WHAT IS HUMAN TRAFFICKING?

Human trafficking is the recruitment, transportation, transfer, harboring or receipt of people through force or other forms of coercion, abduction, fraud, deception with the aim of exploitation.

WHAT IS DOMESTIC SERVITUDE?

Domestic Servitude is a type of forced labour, modern slavery and a form of human trafficking exploitation whereby a victim is working in or for a household or households.

WHAT IS DECENT WORK FOR DOMESTIC WORKERS?

Refers to the work that is productive and delivers a fair income, security in workplace and social protection for domestic workers. Also, it includes better prospect for personal development and social integration, freedom to express their concerns, associate and participate in decisions that affect their lives and equality of opportunity and treatment for all regardless of their gender, historical background, race, political opinion, age, religion, language, disability, health status, custom, ethnic origin and socio-economic status.

WHAT IS FORCED LABOUR?

Forced Labour refers to the situation in which persons are coerced to work through the use of violence or intimidation, or by more subtle means such as accumulated debt, retention of identity papers or the threats of denunciation to immigration authorities.

WHAT ARE THE FORMS OF LABOUR EXPLOITATION?

The forms of labour exploitation include child labour, sexual exploitation, debt bondage, modern slavery and forced criminality.

HOW DOES WOTESAWA COLLABORATE ?

We embrace partnership and collaboration with individuals and institutions through advocacy, national and international events, coalitions, cross-cutting issues, training, seminars and workshop.

DO DOMESTIC WORKERS HAVE A RIGHT TO SOCIAL SECURITY PROTECTION?

Yes, The National Social Security Fund (NSSF) applies in mainland Tanzania in relation to a person who is also employed in the private sector. Therefore, Domestic workers have the right to Social Security Protection because are employed in the private sector.

WHAT IS LIGHT WORK TO A CHILD ?

“Light work” constitutes work which is not likely to be harmful to the health or development of the child and does not prevent or affect the child’s attendance at school, participation in vocational orientation or training programmes or capacity of the child to benefit from school work.

IS A DOMESTIC WORKER ENTITLED TO ANNUAL PAID LEAVE?

Yes, an employer is required to grant a Domestic Worker at least 28 consecutive days’ paid leave after every 12 months; and such leave shall be inclusive of any public holiday that may fall within the period of leave
